What can we do? I ask the question, when you don’t know the answer to a taxation question, you call you accountant, when you have a question about your lease you call you lawyer.  So how do you call when you have an issue with managing one of your employees?  Most people are stumped over this question; the first answer is usually your lawyer.  This response will get you the required outcome if they specialise in employment law, however there will also be significant billable hours coupled with your enquiry. So what can an outsourced human resources professional help you with? Firstly, the majority of the time we come into a company it is because someone has opened Pandora’s box.  There are many examples of this some are:
  • An employee making a wage claim
  • Receipt of an unfair dismissal claim from Fair Work Australia
  • A complaint has been made by an employee and the business has not reacted to it satisfactory
  • An employee is performing poorly for a period of time and it is not managed

What do we find? Usually we find that there are no frameworks, that is, employment contracts, or policies have not be developed or implemented.  This does make it somewhat difficult to manage as the business has not communicated effectively the expectations of the employee or the company. Or we find that the business has contacted Fair Work or accessed their site, usually they are aware they should be doing something, but they don’t have the time or the in-depth knowledge to decipher and apply the legislation to their business.
